1. How the web works
Search a lodging on the OBF searcher, according to your needs of dates, amount of people to occupy the lodging, and/or the number of rooms you want your apartment to have.
Choose according to your interest one of the available apartments in the result of your search on the OBF web searcher. Once your selection is done, you can access the page with fully information about the apartment selected. There you will find detailed information about the features of the selected apartment, its surroundings, photos of the apartment, a location map of the area and a distribution map of the apartment. Besides, you will be able to find all the details of your reservation, dates of arrival and departure, number of people staying, total fee and fee of the reservation. In the event that you want to change the dates of your reservation, you can do so on this page where there is a list of fares and a calendar at your disposal to know which days are available and more adequate to your reservation. It is important that you read and confirm all the information of your reservation as well as the additional information of each apartment. Once this information is confirmed you can formalize the reservation.
2. Fees and fares
The fees and fares of Gentil Rent S.C.P. are published in the respective section of each of the apartments offered by this company.
There are four types of fares according to the season or the offers or special increases, specified in each case. The seasons are the low and the high season, and the variable prices are offers or special fees (in case of increase). The individual fees of each type of lodging are public and visible on the web page and are linked to the calendar of each of the apartments offered. The fare of the seasons and the variable fares are fixed by the owners of the apartments in common agreement with the fares of Gentil Rent S.C.P.
3. Booking and payment
In the booking form of the rental agreement you will find once more the information of dates, number of lodgers and fees of your reservation. In this form you must fill the requested information and accept the conditions established by Gentil Rent S.C.P. for the agreement you sign. Accepting the conditions established by Gentil Rent S.C.P., you accept that the information you are providing to this company is true and that the identity and the number of people who have made the reservation are true as well. The falseness of the information in the rental agreement is a reason to cancel the agreement and therefore the loss of the remaining days of stay and the money left as deposit. Reservations to minors (under 18) are not permitted.
Once the reservation of the selected apartment is made, the client must fulfil the payment through one of the safe ways of payment in order to make the reservation effective. Gentil Rent S.C.P. offers three ways of safe payment. The first is by the TPV way, the second by PayPal (in which the client must have an account or sign on to one)or the by bank transfer, in which the client commits to send to Gentil Rent S.C.P. (see ways of contact) a copy of the transfer document made by their bank within less than 48 hours. Otherwise Gentil Rent S.C.P. has the right to cancel the reservation made by the client. The reservation will not be considered finished until the payment of the reservation is made and you have received a confirmation of the same. In this e-mail you will obtain all the details of your reservation, the contact information at your arrival, the exact address of your apartment, as well as additional information regarding your booking, your lodging and its surroundings. Once you arrive to your destination in the selected apartment you must pay the rest of the total fee of the lodging in cash –which includes the rest of the payment of the invoice and the deposit of the apartment. Once these payments are made you can check in. Only in the event that it is specified in the e-mail of confirmation you can pay the rest of the aforementioned payments (rest of the stay and deposit) by VISA, MASTERCARD or AMERICAN EXPRESS cards, with a 4% extra charge on the whole of the invoice.
4. Deposit, cancellations, changes and/or modifications
Deposit:
When the client arrives to the selected apartment they must leave a deposit in cash or by credit card (the amount is specified in the rental agreement), as well as a valid credit card number during your stay in respect of warranty of any damage caused by the client during the stay, which includes the content as well as the container of the selected apartment, and also any damage caused to the surroundings of the building of the selected apartment.
The surroundings are understood as the whole block of flats where the apartment is located, as well as the neighbourhood, this is, the people that live in the same building or surroundings.
This deposit will be fully refunded to the client once they leave the apartment according to the terms of use accepted by the client in the rental agreement signed with the acceptance of “Terms and conditions of use of Gentil Rent S.C.P.”
Refund of the deposit in cash: in the event that the payment of the deposit has been made in cash, the deposit will be fully refunded once the appropriate return of the apartment and its surroundings have been done.
Refund of the deposit by credit card: in the event that the deposit has been made by credit card, the deposit will be refunded by credit card to the same bank account once the appropriate return of the apartment and its surroundings have been done within 7 to 9 days.
Cancellation of the reservation agreement:
Fee policy of penalizing a cancellation of a reservation agreement:
- From the confirmation date of the reservation until 3 working days. In this case Gentil Rentil S.C.P. will charge the client a fixed amount of 40 euros in respect of management expenses plus the commissions by payments made by credit card. - With more than 30 days of advance to the confirmation date of the reservation, Gentil Rent S.C.P. will charge the client 60% of the amount in respect of penalization (for the loss of other reservations) and management expenses plus the commissions by payments made by credit card. - With less than 30 days of advance to the confirmation date of the reservation, Gentil Rent S.C.P. will charge the client 100% of the amount in respect of penalization (for the loss of other reservations) and management expenses.
In the event that any of these fares clash, the one imposed will be the one more beneficial to the client. Excluded from these conditions of cancellation are the reservations made in periods of offer or special prices in which the third condition will be imposed (charge of 100% of the reservation)
Changes and/or modifications in the reservation agreement:
Any changes and/or modifications of the reservation agreement will be taken as a cancellation (a reservation is considered firm when it has been confirmed by an e-mail from Gentil Rent S.C.P.) and the same conditions of fares imposed in the aforementioned section of “cancellation of a reservation agreement” will be imposed.
Cancellation due to major force:
In the event that by any unexpected circumstance o major force the client cannot lodge in the selected apartment (reserved), Gentil Rent S.C.P. commits to offer the client an apartment with similar characteristics to the one previously reserved. In the event that the client is not satisfied with the alternative choice of lodging offered by Gentil Rent S.C.P., any of both parts of the agreement are authorized to resign the contract established with the reservation. In case of rescission of the contract, Gentil Rent S.C.P. will refund the client all the payments made until that moment, except those that correspond the payment of the days the apartment has been used (if such is the case). In this event, Gentil Rent S.C.P. will not assume any other responsibility derivative from the rescission of the contract of the reservation, fully or partly.
5. Behaviour, truthfulness of the information, legal liability y reasons of cancelling the contract
Behaviour:
Gentil Rent has a very strict policy of safety and coexistence. We bet on a responsible tourism and of mutual enrichment. For our company a respectful treatment with the neighbourhood and its surroundings is essential.
We please ask the clients of Gentil Rent S.C.P. to inform the company or the contact person any problem, complaint, misunderstanding that could arise with the neighbourhood where the apartment is located.
A penalty of loss of all vested interests will be applied without the right to claim (detailed further on), in the event of any behaviour considered uncivil or disrespectful towards the neighbours, the continent or the container of the apartment or its surroundings.
In Gentil Rent S.C.P. we have established a behaviour pattern according to which, in the event of inadequate behaviour, the client will be warned on this matter. This warning will be considered a minor offense. A second warning will mean a serious offense and therefore the immediate expelling from the apartment and the loss of all vested interests. The direct warning of serious offense will of course involve the immediate expelling from the apartment and the loss of all vested interests.
Minor offenses:
* noise excess at any time of the day;
* not to respect the terms of use of the common space of the neighbourhood (the unawareness of the language is not considered an exemption of this observance);
Serious offenses:
* not to respect the conditions of the booking contract, regarding the identity of the people, the truthfulness of the given information and the number of people lodged in the selected apartment;
* any act of violence in or outside the apartment;
* to hold parties or noisy activities during the sleeping time of the neighbours (from 10 pm to 10 am);
* to damage the continent or the container of the apartment, the building where it is placed, and its surroundings;
* any activity penalized by the Spanish law.
Truthfulness of the reservation agreement information and stay:
It is responsibility of the client to provide true information regarding the people that will lodge in the selected apartment, as well as the number of people. Any incompliance in this way will be considered a serious offence and therefore will be a reason of unilateral rescission of the contract on behalf of Gentil Rent S.C.P. as it is detailed on point 6 in this contract.
Legal liability:
Gentil Rent S.C.P. is not responsible for any financial compensation due to possible incidents that can occur in or outside the selected apartment, due to direct or indirect consequence of the use the client has given to the selected apartment. There is no right to financial compensation of any kind for damage, robbery, accidents, loss or inadequate behaviour (activities penalized by the Spanish law). The owner of the apartment will be the last responsible to any complaint carried out by the client in case of conflict between the parts (client and owner) as well as any other litigation derivative from the use of the apartment as temporary rent.
Any detection by Gentil Rent S.C.P. of an inadequate use of the apartment or its surroundings will be considered a serious offence and therefore it is a reason of unilateral rescission of the contract by Gentil Rent S.C.P. as it is detailed in point 5 in this contract.
Jurisdiction area and language:
The jurisdiction area of the present contract is the one passed by the Spanish laws and in case of judicial contest the Spanish law and the Spanish language will prevail in the event of misunderstanding when interpreting this contract “Terms of use of Gentil Rent S.C.P.”
6. Reasons of unilateral rescission on the part Gentil Rent S.C.P. of the reservation agreement
Reasons of rescission of the reservation agreement and loss of the deposit and payments related to the stay made without right to claim until the moment they occur, are the ones specified in point 5 (serious offences). Likewise, the recidivism of minor offences with the following warning by Gentil Rent S.C.P. or the contact person will involve the rescission of the reservation agreement and the consequences detailed above.
7. Arrival and departure (check in – check out)
The arrival and departure information, as well as that of check in and check out are detailed in the e-mail of confirmation of the reservation agreement. In the aforementioned e-mail the stages to follow are detailed once the reservation agreement is confirmed.
Arrival:
to be sure that you obtain a pleasant arrival to the selected apartment, we please ask you to get in touch with the contact person (information detailed in the e-mail of confirmation of the reservation agreement), in no less than 3 working days before your arrival, with the information of your arrival updated. In this way we can plan and assure you a check in without delay.
Once this information is obtained, the contact person will get in touch with you via e-mail (or in case of urgency by mobile phone) and will give you the indications to follow in order to welcome you in the selected apartment (check in).
Please take into account that the apartment is available from 2 pm to 2 am. From 11 pm there is an extra charge of 50 euros in item of late arrival.
Departure: departure time from the apartments is at 11 am. In case you need to stay after 11 am, you must agree in advance with the contact person the day of arrival, and in the event you are authorized you must pay an occupation rate of 30 euros in item of part-time until 6 pm. In the event that you should stay after 6 pm you must pay a whole day of stay in cash to the contact person.
On the departure day the apartment must be clean and tidy and the litter left in the respective litter container. Please do not forget to leave all the set of keys given in the place indicated by the contact person. 8. Data protection
Gentil Rent S.C.P. warranties their clients that we respect the state regulations of Spain of data protection and that your data will not be used for any other event or aim that is not related with the maintenance of the data base of the clients of Gentil Rent S.C.P.
By accepting the present contact “Terms of use of Gentil Rent S.C.P.”, the client is informed and agrees to be part of the data base of Gentil Rent S.C.P., and allows this company to use this data to inform you regularly about our commercial activities. In the event you do not want to be part of this data base, you should express it explicitly by sending an e-mail to the contact address of Gentil Rent S.C.P.
9. Reserved rights
Making a reservation with Gentil Rent S.C.P. implies the acceptance of all the sections included in this contract and the information given on the web site. Gentil Rent S.C.P. reserves the right to change at any moment, by needs of the company, the data and terms of use of the web site and this contract. Making a reservation implies the acceptance of the possibility that changes in the data and terms of use of the web site as well as the present contract may have been done. It is responsibility of the client to up-date the information and terms of use aforementioned.
Once the reservation is made and confirmed by Gentil Rent S.C.P., the facts of fares, dates and number of clients is to be taken into account as firm facts (except cancellations due to major force). In this event it is responsibility of the client only to be informed about the changes that might have occurred in the present contract “Terms of use of Gentil Rent S.C.P.”
Only people over 18 are allowed to carry out deeds on this web site. Gentil Rent S.C.P. is not responsible for any information of web sites linked from its own web site, as well as any information about this company and its web site out of its field.
10. General terms
Gentil Rent S.C.P. is a brokerage company of holiday lodgings. Its task and purpose is to provide clients apartments registered on this web site. Gentil Rent S.C.P. establishes a contractual relationship with the owners of the apartments which oblige the owners to provide veracious information of the apartments and Gentil Rent S.C.P. to publish them on the web site. All the information shown on the web site related to the apartments offered has been given by their owners; any omission or errors will be their responsibility.
